Circular 19/2015/TT-BNNPTNT: Arrangement and stabilization of residents outside the district, within the province in Vietnam - Illustrative Image

In Article 6 of Circular 19/2015/TT-BNNPTNT, regulations on the arrangement and stabilization of the residents outside the district, within the province in Vietnam are as follows:

For the Commune People's Committee of the departure location:

Implement according to the provisions in points a, b, c, d, Clause 1, Article 5, Circular 19/2015/TT-BNNPTNT;

Based on the Decision to relocate to the project area, the plan of the District People’s Committee of the departure location, and the Decision to receive residents in the project area, the Commune People's Committee of the departure location shall announce the list of households arranged and stabilized.

For the Commune People's Committee of the destination location: Implement according to the provisions in Clause 2, Article 5, Circular 19/2015/TT-BNNPTNT.

For the District People’s Committee of the departure location:

- Direct relevant rooms and departments under the District People’s Committee assigned to manage population arrangement:

- Receive dossiers from the Commune People's Committee and issue a receipt with a date for results immediately upon receiving the dossier (in the case of direct submission);

- Within 30 working days from the date of receiving complete and valid dossiers from the Commune People's Committee, assist the District People’s Committee in organizing the dossier appraisal and propose the District People’s Committee issue a Decision to relocate to the project area, the arrangement, and stabilization plan; and at the same time, advise the District People’s Committee to send documents (enclosed with the Decision to relocate to the project area, the arrangement and stabilization plan) proposing the District People’s Committee of the destination location to issue a Decision to receive the population arrangement and stabilization to the project area, the plan.

- Coordinate with the District People’s Committee of the destination location to hand over and bring the arranged households to the project area, the plan.

For the District People’s Committee of the destination location:

- Direct relevant rooms and departments assigned state management responsibilities for the population arrangement within the district, and the Commune People’s Committee to receive and check the project area, the plan, and make a report (Appendix IV issued with this Circular);

- Within 30 working days from the date of receiving the document from the District People’s Committee of the departure location, based on the population arrangement and stabilization plan assigned by the Provincial People’s Committee; organize the verification of the area for receiving residents, consider, and issue a Decision to receive and stabilize the population in the project area, the plan and send the aforementioned Decision to the relevant levels and sectors;

- Coordinate with the District People’s Committee of the departure location to organize the reception of households into the project area, the plan (Appendix VI issued with Circular 19/2015/TT-BNNPTNT);

- Direct relevant units to implement policy payments for households according to current regulations (Appendix V issued with Circular 19/2015/TT-BNNPTNT);

- Direct to make the acceptance report (Appendix VII issued with Circular 19/2015/TT-BNNPTNT).

More details can be found in Circular 19/2015/TT-BNNPTNT, which comes into effect in Vietnam from June 10, 2015.
