Recently, the Ministry of Industry and Trade issued Circular 14/2020/TT-BCT providing guidelines on certain regulations for industry and trade sector inspections, which comes into effect in Vietnam from August 15, 2020.
Circular 14: Duties and Powers of Departments affiliated to the General Department of Market Surveillance in Vietnam
Article 5 Circular 14/2020/TT-BCT stipulates 06 duties and powers of the Department affiliated to the General Department of Market Surveillance, which include:
Additionally, this Circular also stipulates the duties and powers of heads of agencies assigned to perform specialized inspection functions as follows:
- Specifically define the functions, duties, and powers of advisory units, heads of advisory units, and the working relationship between advisory units and other departments within the agency regarding specialized inspection and administrative violation handling work.
- Decide on the assignment of officials affiliated to their management who meet the conditions and standards to perform specialized inspection duties.
- Propose the Ministry of Industry and Trade to issue inspection credentials to those who meet the conditions.
- Suspend the use of credentials as prescribed in Article 12 of this Circular, revoke credentials as prescribed in Article 13 of this Circular and send them to the Ministry's Inspectorate.
- Be responsible for the standards of persons assigned to perform specialized inspection functions and for proposing the issuance of credentials.
