Certain Cases of Land Levy Reduction from February 10

The Ministry of Finance has issued Circular 332/2016/TT-BTC to amend and supplement Circular 76/2014/TT-BTC on land levy (TSDD).

Circular supplementing some cases of land use fee reduction applicable to infrastructure cemetery and burial ground transfer projects connected with infrastructure as follows:

First, for cases of land allocation from December 27, 2015, to February 10, 2017, subject to preferential treatment under Decree 118/2015/ND-CP and having submitted applications for land use fee reduction as per regulations in Circular 76/2014/TT-BTC.

Second, a 50% reduction in land use fees for projects located in areas of special socio-economic difficulties or for projects with a capital of 6,000 billion VND or more, having disbursed at least 6,000 billion VND within three years from the date of investment registration certificate issuance or investment approval.

Third, a 30% reduction in land use fees applicable to projects in areas with socio-economic difficulties or in rural areas utilizing at least 500 laborers.

Fourth, a 20% reduction in land use fees for projects not falling within the two cases mentioned above.

Circular 332 also supplements regulations on determining the starting price for auctioning land use rights to allocate land with a land use levy.

Specifically, if the land parcel or auctioned land area for which land use fees are calculated has a value under 30 billion VND in centrally-run cities; under 10 billion VND in mountainous, highland provinces; under 20 billion VND in other provinces, the starting price is the specific land price determined by financial authorities based on the land prices in the provincial land price list and the land price adjustment coefficient issued by the provincial People's Committee.

In cases where the land parcel or auction land area for which land use fees are calculated has a value from 30 billion VND or more in centrally-run cities; from 10 billion VND or more in mountainous, highland provinces; from 20 billion VND or more in other provinces, the starting price is the specific land price determined by the Department of Natural Resources and Environment, submitted to the local Land Price Appraisal Council chaired by the Department of Finance for appraisal.

Circular 332/2016/TT-BTC takes effect from February 10, 2017.
