Recently, the Government of Vietnam has issued the Decree No. 129/2020/NĐ-CP on the functions, tasks and operational mechanism of the Vietnam Debt and Asset Trading Corporation (DATC).
According to the Decree No. 129/2020/NĐ-CP of Vietnam’s Government, business lines of Vietnam Debt and Asset Trading Corporation (DATC) include:
1. Main business lines
* Receiving, handling debts and assets:
- Receiving debts and assets in accordance with the law on conversion of ownership of wholly State-owned enterprises, including public non-business units carrying out equitization in accordance with the Government's regulations for handling according to the provisions of this Decree;
- Receiving debts and assets designated by the Government or the Prime Minister, including: receivables and assets (including outstanding assets, assets associated with debt settlement under decisions of the Government or Prime Minister) to continue to invest in mining or to process and recover capital for the State according to the provisions of this Decree.
* Buying and handling debts and assets, including:
- Manage and use mainly the company's financial resources to purchase and handle debts and assets (including projects that need debt settlement support to continue investing and exploiting) as designated by the Government or the Prime Minister;
- Buy and handle debts and assets of organizations and individuals that do not coincide with the goals and political tasks of the Vietnam Asset Management Company (VAMC).
* Corporate restructuring through buying, selling and debt settlement activities.
2. Business lines supporting main business lines
- Management, investment, exploitation and handling of real estate projects in the following cases: assets to secure a debt, assets to be assigned a debt, and assets purchased or received under the appointment of the Government or the Prime Minister in accordance with the provisions of law;
- Consulting on debt, asset, purchase, sale, merger, and restructuring;
- Conducting valuation activities; debt management and debt collection services on the basis of ensuring all operating conditions as prescribed by law.
