Recently, the Ministry of National Defense issued Circular 01/2018/TT-BQP promulgating the Regulations on the Military Judicial Enforcement Sector.
According to Circular 01, the responsibilities and scope of work of the Head and Deputy Head of the Military Enforcement Department at the regional military level are as follows:
1. Head
- Responsibility: Responsible before the law, the Communist Party, the Chief of the General Staff, the Commander of the Military Region, the Navy Command, and the Director of the Enforcement Department for civil enforcement work under their jurisdiction.- Scope of work:- Tasks within the function, duty, and authority of the head of the enforcement agency as stipulated by law and the Ministry of Defense; tasks assigned or authorized by the Chief of the General Staff, the Commander of the Military Region, the Navy Command, and the Director of the Enforcement Department;- Report to the Chief of the General Staff, the Commander of the Military Region, the Navy Command, and the Director of the Enforcement Department on issues and tasks that are difficult, obstructive, or beyond their authority;- Advise and propose to the Chief of the General Staff, the Commander of the Military Region, the Navy Command, and the Director of the Enforcement Department on institutional building work, management document creation, operational guidance, command; civil enforcement work; the sector building work;- Assign and delegate tasks to subordinates and execute the agency's duties; proactively cooperate with relevant agencies and units to resolve related tasks.
2. Deputy Head
- Responsibility: Responsible before the law and the Head for the tasks assigned, managed, or authorized.- Scope of work:- Command, manage, and resolve tasks as assigned or authorized by the Head and report the results to the Head;- Proactively cooperate with relevant agencies and units to resolve related tasks; report to the Head to decide on issues and tasks that are difficult, obstructive, or beyond their authority;- Sign documents on behalf of the Head within the Head's authority in the scope of work assigned or authorized by the Head.
Circular 01/2018/TT-BQP takes effect from March 25, 2018.
