Assets Equipped for Deployment of Budgetary Support Tasks

Decree 70 stipulates several regulations regarding assets equipped for implementing specific budget support tasks as follows:

Management and use of assets equipped for implementing budget support tasks

According to Decree 70, the state possesses the ownership of the assets corresponding to the contributed capital in scientific and technological tasks.

The management, use, and handling of assets for scientific and technological tasks with budget support are performed according to the contract signed between the competent state authority and the organization or individual presiding over the implementation of the scientific and technological tasks, in which the state-owned asset ownership portion and the form of handling must be clearly stated;

The authority or the person authorized to approve the budget support tasks decides the form of handling the part of the asset ownership belonging to the state.

Forms of handling state-owned assets equipped

State-owned assets equipped are handled through the following methods:

- The state transfers the state-owned equipped assets without compensation to the organization or individual presiding over the implementation of scientific and technological tasks in the following cases:- Tasks supported by the state with no more than 30% of the total capital;- Other scientific and technological programs as approved by the Prime Minister of the Government of Vietnam, which stipulate the non-compensated transfer of equipped assets by the state.- Selling the state-owned portion to the organization, individual presiding over the task or selling to other organizations, individuals by agreement of the co-owners in cases not mentioned in Clause 1 of this Article.- Transferring the use right of the state-owned portion to the organization, individual presiding over the task in cases where the presiding organization, individual does not buy the assets and they cannot be sold to other organizations, individuals.- The consideration and decision to transfer based on the acceptance council's conclusion on the capability to continue utilizing, completing the commercialization results of technology, products, and the proposal of the scientific and technological task management authority is carried out as follows:- For national-level scientific and technological tasks: Minister of Science and Technology- For ministerial-level scientific and technological tasks: Ministers, heads of central agencies- For locally managed scientific and technological tasks: Provincial People's Committees- The presiding organization is responsible for reimbursing the asset value through the commercialization of the results.- The procedures for transferring the use right of state-owned equipped assets are implemented according to legal regulations and guidelines by the Ministry of Science and Technology.

Decree 70/2018/ND-CP takes effect from May 15, 2018.
