7 Principles in Management and Utilization of Non-Refundable Aid

The Government of Vietnam has just signed and promulgated Decree 80/2020/ND-CP on the management and use of non-refundable aid not classified as official development assistance from foreign agencies, organizations, and individuals for Vietnam.

In Article 4 of Decree 80/2020/ND-CP, provisions are made for 07 principles in the management and use of non-refundable aid, not part of official development assistance, from foreign agencies, organizations, and individuals for Vietnam, specifically:

- The management and use of aid must comply with Vietnamese law. Aid will only be accepted, implemented, and used when approved by the competent authority of Vietnam. Aid funds must be legitimate funds and assets.- Do not accept goods (including materials and equipment) that are on the prohibited import list as per legal regulations.- The managing agency is comprehensively responsible for the effective management and use of the aid.- The receipt and expenditure of aid must be carried out through an aid reception account, ensuring openness, transparency, and comprehensive reporting as stipulated in Chapters III, IV, and V of this Decree.- Aid related to state budget revenues must be fully estimated, accounted, and settled into the state budget.- For aid not part of state budget revenues, the aid account holder is allowed to manage independently and is responsible for the purpose of use, and the results, ensuring compliance with Vietnamese law and commitments with donors. The aid account holder periodically reports to the managing agency for aggregation and reporting to the Ministry of Planning and Investment for overall consolidation.- After 06 months from the date the aid is approved, if the aid has not been deployed without justifiable reasons, the approving authority is allowed to revoke the decision to approve the receipt of the aid. The managing agency is responsible for notifying the aid provider about the revocation of the aid approval decision.
