07 Cases of Termination of Legal Practice Apprenticeship for Apprentices

According to the provisions of Circular 19/2013/TT-BTP, an apprentice lawyer shall cease their apprenticeship in the following cases:

- Voluntarily terminating the lawyer apprenticeship;- Being recruited as officials and public employees; officers, professional soldiers, defense workers in agencies or units under the Vietnam People's Army; officers, non-commissioned officers, workers in agencies or units under the People's Police;- No longer residing in Vietnam;- Convicted with a legally effective judgment;- Being subjected to administrative measures for compulsory rehabilitation or compulsory education;- Being disciplined with a suspension from lawyer apprenticeship from three to six months;- Being disciplined by removal from the list of apprentices of the Bar Association.

However, an apprentice who ceases the lawyer apprenticeship may be reconsidered for re-registration of apprenticeship upon meeting the registration conditions according to the provisions of Circular 19/2013/TT-BTP and one of the following conditions:

- The apprentice ceases the apprenticeship as stipulated in points a, b, and c, Clause 2, Article 8, and the reason for cessation no longer exists.- The criminal record has been expunged except in cases specified in Clause 4, Article 19 of the Law on Lawyers;- The decision to apply administrative measures for compulsory rehabilitation or compulsory education has been fully implemented;- After one year from the date of the disciplinary decision as stipulated in point e, Clause 2, Article 8;- After three years from the date of the disciplinary decision as stipulated in point g, Clause 2, Article 8.

Note: The time spent on apprenticeship before ceasing will not be counted in the total apprenticeship period.
