One of the issues that many people have been concerned about recently is under which circumstances an employee can take personal leave but still receive full salary.
Employees are entitled to paid leave under the following circumstances:
- Marriage (3 days leave)
- Death of biological father or mother (3 days leave)
- Death of father-in-law, mother-in-law, or husband’s father, husband’s mother (3 days leave)
- Death of spouse (3 days leave)
- Death of child (3 days leave)
- Child's marriage (1 day leave)
The above content is based on Clause 1, Article 116 of the Labour Code 2012.
The salary used as a basis to pay for employees during the aforementioned personal leave days is the salary stated in the labor contract of the previous month, divided by the number of normal working days in the month as regulated by the employer, multiplied by the number of personal leave days with pay that the employee is entitled to. (Based on Clause 2, Article 26 of Decree 05/2015/ND-CP).
