05 State agencies with tasks and powers in state management on grant aid in Vietnam

This content is stipulated in Decree 80/2020/ND-CP regulating the management and use of non-refundable aid not classified as official development assistance provided by foreign agencies, organizations, and individuals for Vietnam.

Chapter V of Decree 80/2020/ND-CP stipulates the tasks and powers of 05 State agencies concerning grant aid not classified as official development assistance. These include: Ministry of Planning and Investment, Ministry of Finance, Ministry of Foreign Affairs, Ministry of Public Security, and Ministry of Home Affairs, detailed as follows:

1. Ministry of Planning and Investment of Vietnam

- Acts as the lead agency with the duty of state management over aid within the scope of this Decree.

- Responsible for drafting and submitting for promulgation or promulgating legal documents on the management and use of aid according to its authority.

- Leads the appraisal and aggregates opinions from relevant agencies to submit to the Prime Minister for consideration and approval of aid packages within the Prime Minister's authority.

- Submits annual comprehensive reports to the Prime Minister on the management and usage of aid; recommends solutions to improve the effectiveness of aid management within the scope of this Decree.

- Inspects compliance with regulations on the receipt, approval, and implementation within its authority concerning agencies and units receiving aid under this Decree.

2. Ministry of Finance of Vietnam

- Leads and cooperates with relevant agencies to develop policy guidelines on state financial management concerning aid.

- Provides input on aid packages as stipulated.

- Manages state finances concerning aid as a source of state budget revenue.

- Consolidates financial management data for aid packages. Annually sends reports to the Ministry of Planning and Investment for synthesis and reporting to the Prime Minister.

- Inspects and supervises the financial management situation and compliance with financial regulations for organizations and units receiving aid under this Decree.

3. Ministry of Foreign Affairs of Vietnam

- Provides feedback on aid packages as stipulated.

- Participates in monitoring the implementation of aid from foreign non-governmental organizations according to aid commitments and ensures the activities registered with competent state agencies are carried out correctly.

- Regularly and fully provides information on the issuance, extension, amendment, and supplementation of Registration Certificates and activities of foreign non-governmental organizations, serving as a basis for mobilizing and appraising aid from these organizations as stipulated in this Decree.

4. Ministry of Public Security of Vietnam

- Guides and supports Vietnamese agencies and organizations in the reception and use of aid to comply with Vietnamese law concerning national security protection and maintaining social order and safety.

- Participates in the appraisal and provides opinions to the Ministry of Planning and Investment on related aid packages before submitting to the Prime Minister for consideration; participates in appraisal and provides feedback.

- Cooperates with relevant agencies in inspecting and supervising the reception and use of aid to ensure political security and social order and safety.

- Executes tasks within its authority upon detecting legal violations related to the reception and use of aid.

- Provides related information as a basis for appraisal of aid packages to the Ministry of Planning and Investment, Ministry of Finance, Ministry of Foreign Affairs, and Ministry of Home Affairs.

5. Ministry of Home Affairs of Vietnam

- Leads the appraisal of approval according to its authority; participates in appraisal and provides opinions on the reception of aid packages with related content.

- Guides and supports Vietnamese agencies and organizations in complying with the nation's religious policies in the reception and use of aid.

- Consolidates annual data on the management and use of aid by organizations subject to Vietnamese law concerning associations, social funds, and charitable funds. Annually sends reports to the Ministry of Planning and Investment for synthesis and reporting to the Prime Minister.

- Inspects and supervises the reception, management, and use of aid by associations, social funds, and charitable funds according to the state management authority of the Ministry of Home Affairs.
