05 Principles on Environmental Protection inspection in the People's Public Security Force in Vietnam

Recently, the Ministry of Public Security issued Circular 69/2020/TT-BCA stipulating the inspection of environmental protection work in the People's Public Security Forces, which comes into effect in Vietnam from August 06, 2020.

05 Principles on Environmental Protection inspection in the People's Public Security Force in Vietnam

Circular 69/2020/TT-BCA stipulates 05 principles for inspecting the environmental protection work in the People's Police Force in Vietnam, including:

  1. Ensure accuracy, objectivity, and honesty.
  2. Comply with the provisions of law, work regulations of the Ministry of Public Security (BCA); orders of the People's Public Security Force (CAND); regulations on the protection of state secrets and operational secrets of the CAND force.
  3. Do not obstruct the normal activities of the police units, localities, organizations, and individuals involved.
  4. For a specific inspection content, at a specific time, in a specific unit, only inspect once; subsequent inspections related to already inspected contents should only cite the previous inspection results, except in cases where it is deemed necessary to re-inspect due to new circumstances, clearly stating the basis and purpose for re-inspection of that content.
  5. Apply legal provisions, national technical standards on the environment, and other regulations in international treaties to which Vietnam is a member as the basis for determining the current state of the environment and the extent of legal violations on environmental protection by the inspected subjects.

Additionally, this Circular stipulates the authority to inspect environmental protection work as follows:

- Leaders of the BCA decide on the establishment of inspection teams and approve inspection plans for inter-sector inspection teams led by the BCA, with the participation of multiple agencies and organizations to handle issues related to the environmental protection work of the BCA.

- The Director of the Health Department decides on the establishment of inspection teams and approves environmental protection inspection plans for police units and localities according to the state management function on environmental protection in the CAND. Develop long-term and annual programs for inspecting environmental protection work in the CAND for approval by BCA leaders.

- Heads of units under the BCA, Directors of provincial and municipal police under the Central Government decide on the establishment of inspection teams and approve the inspection plans conducted by their respective units.
