Recently, the National Assembly of Vietnam has approved the Law on amendments to the Law on prevention and control of HIV/AIDS 2020.
According to Clause 10 Article 1 of the Law on amendments to the Law on prevention and control of HIV/AIDS 2020 of Vietnam, 04 groups of persons have the right to access to information about HIV-positive persons include:
- Persons mentioned in Point d Clause 2 Article 30 of this Law: Heads of agencies/units assigned to carry out HIV/AIDS epidemiological surveillance; persons assigned to carry out HIV/AIDS epidemiological surveillance;
- Heads and persons assigned with tasks of social security offices that directly perform assessment, make payments and manage information about covered medical services provided for HIV-infected persons;
- Heads and persons assigned with tasks of health facilities that directly make payments and manage information about covered medical services provided for HIV-infected persons;
- Persons authorized by HIV-infected persons to access their information.
The following information about HIV-infected persons will be accessed:
- Personal information prescribed in Clause 2 Article 29 of this Law: HIV test result, residential addresses, ID cards, citizen’s identity cards, passports or other unexpired photo-bearing identification documents issued by competent authorities.
- HIV/AIDS epidemiological information;
- HIV/AIDS treatment status.
Persons who have the right to access information about HIV-positive persons must assume responsibility to protect confidentiality of information about HIV-infected persons.
