Decree 36/2015/ND-CP stipulates the criteria for establishing Provincial, Inter-provincial, and Central City Customs Departments; the organization, duties, and activities of Customs at various levels, issued on April 17, 2015.

Decree 36/2015/ND-CP stipulates that the establishment of a Customs Department stems from the requirement of state management activities on customs in provinces, inter-provincial regions, cities under central authority, and adheres to the following principles:
- Align with the requirements of the administrative reform program, the customs reform and modernization program approved by the Government of Vietnam and the Prime Minister of the Government of Vietnam.
- Meet the criteria for establishing a Customs Department as regulated in this Decree.
- Ensure compliance with the procedures for setting up state administrative organizations in accordance with the law.
Furthermore, the Decree also stipulates the responsibilities of Ministries, agencies, and localities regarding the establishment of a Customs Department as follows:
General Department of Customs
- Propose the establishment of a Customs Department to the Ministry of Finance.- Organize the implementation of the Customs Department's activities according to the establishment decision.
Ministry of Finance
- Based on the provisions of Articles 3 and 4 of this Decree, develop the Scheme for establishing the Customs Department, report to the Prime Minister of the Government of Vietnam for review and decision.- Direct and ensure the necessary conditions for the operation of the Customs Department.
Ministry of Home Affairs: Appraise the establishment of the Customs Department in accordance with the law.
Provincial People's Committee where the Customs Department is expected to be established: Ensure the necessary conditions for the operation of the Customs Department.
