03 conditions to participate in the project under housing policy in the Military in Vietnam

Regarding the conditions to participate in the project under housing policy in the Military in Vietnam, stipulated in Circular 177/2011/TT-BQP, which defines the subjects, conditions, principles, order, and procedures for participating in housing development projects, homestead land policy, and resolving housing policies in the Military, issued by the Minister of National Defense of Vietnam on September 19, 2011.

To be specific, in Article 3 of Circular 177/2011/TT-BQP, it is stipulated that officers and personnel eligible to participate in policy housing and homestead land projects within the Army must meet the following conditions:

  1. Have at least 10 years of service both inside and outside the Army (service time outside the Army is counted only for periods as an official receiving a salary from the state budget);

  2. Have not benefitted from any housing or homestead land policies (both on their own or spouse’s side) in any of the forms specified in Article 4 of this Circular;

  3. Submit an application to participate in the housing and homestead land development project upon notification from the competent authority (according to Form No. 1, Appendix 1 issued with this Circular).

In Article 4, the forms of policy housing and homestead land are defined as follows:

- The state or local authority allocates homestead land according to land law regulations.

- Rent or purchase state-owned housing according to housing law regulations.

- Purchase, rent to purchase, or rent social housing.

- Various housing and homestead land types within the family housing projects, Army officers housing projects approved by the Ministry of National Defense for policy sale to officers and personnel working in the Army; housing for low-income individuals; housing and homestead land within housing projects for officials and public employees of Ministries, sectors, government agencies, and localities.

- Housing and homestead land specified in Clauses 1, 2, 3, 4 of this Article, but compensated by housing and homestead land by the state when the original housing and homestead land were reclaimed, or when old, damaged, or degraded apartment buildings are renovated according to laws on compensation, support, and resettlement.

- Support for housing improvement through other means as regulated by law (except cases previously supported under Directive 1149/CT-QP dated September 16, 1986, of the Minister of National Defense concerning policy implementation for retired senior officers and surplus personnel).

More details can be found in Circular 177/2011/TT-BQP, which comes into effect in Vietnam from November 15, 2011.
