On February 21, 2023, the Minister of Culture, Sports and Tourism issued Circular 01/2023/TT-BVHTTDL amending Circular 17/2015/TT-BVHTTDL on anti-doping in sports.

In which, 01 Anti-Doping Rule Violation in World Anti-Doping Code is added compared to Circular 17/2015/TT-BVHTTDL as follows:

Anti-Doping Rule Violations in World Anti-Doping Code in Vietnam

According to Article 4 of Circular 17/2015/TT-BVHTTDL (added in Clause 1, Article 1 of Circular 01/2023/TT-BVHTTDL), violations of the World Anti-Doping Code include:

(1) Presence of a prohibited substance or its metabolites or makers in an athlete’s sample.(2) Use of prohibited substances or prohibited methods.

(2) Use of a prohibited substance or prohibited method.

(3) Evading, refusing or failing without compelling justification to submit to sample collection after notification as authorized.

(4) Violation of applicable requirements regarding athlete availability for out-of-competition testing.

(5) Tampering or attempted tampering with any part of doping control.

(6) Possession of a prohibited substance or prohibited method.

(7) Trafficking of any prohibited substance or prohibited method.

(8) Administration to any athlete of any prohibited substance or prohibited method in or out of competition; assisting, encouraging, aiding, abetting, covering up or any other type of intentional complicity involving an anti-doping rule violation.

(9) Conspiring or covering up one or some of violations in Clauses 1 through 8 of this Article.

(10) Association by an athlete in a professional or sport-related capacity with a person such as a coach, doctor, physio or trainer who is serving a sanction for an anti-doping rule violation.

(11) Acts to discriminate or retaliate against reporting on doping activities (Newly added)

Thus, from April 15, 2023, there will be all 11 violations of the World Anti-Doping Code.

Anti-doping rules in sports in Vietnam

The prevention and combat of doping in sports activities must comply with the principles specified in Article 3 of Circular 17/2015/TT-BVHTTDL, specifically as follows:

- Anti-doping activities shall be carried out regularly with attaching special importance to information dissemination and education to increase awareness about consequences of doping.

- Promote close and effective cooperation between domestic and foreign organizations and individuals, and international sports organizations in anti-doping.

- Ensure the compliance with regulations of the World Anti-Doping Agency (WADA) and domestic law regulations of Vietnam in respect of anti-doping in sports.

- Ensure that athletes can train and compete in a clean sports environment and are provided with adequate information about consequences of doping.

Contents of anti-doping education and information dissemination in Vietnam

Specifically, in Article 6 of Circular 17/2015/TT-BVHTTDL, anti-doping education and information dissemination activities are performed to provide athletes and relevant organizations and individuals with accurate information on:

- The World Anti-Doping Code; Vietnam’s regulations on anti-doping.

- Prohibited substances or prohibited methods included in the Prohibited List published by WADA annually.

- Anti-doping rule violations.

- Consequences of doping, including sanctions and health and social affects.

- Doping control procedures.

- Rights and responsibilities of athletes, coaches and medical staff.

- Therapeutic use exemptions.

- Control of risks of using nutritional supplements.

- Effects of doping on the spirit of sports.
